The Parties

Book purchases made through this website, or by post using the downloadable order form provided via the website, will be with Belle Media Limited, whose registered office is 147 Bath Street, Glasgow, G2 4SN, Company No SC354916 (Belle Media).

Payment

Belle Media must receive payment of the whole of the price for the goods and any postage and packing charges before your order can be accepted, and the contract formed.

Pricing

Belle Media is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our website. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by email. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether at no cost to yourself.

Withdrawal by you from the contract

You may withdraw your order for goods at any time but if you withdraw your order and Belle Media has already processed the goods for delivery and you have received them, you must not unpack the goods but must immediately send the goods back in perfect condition to Belle Media at Belle Media Returns 36 / 5 Ferry Lane, Ferry Quays, Brentford, Middlesex, TW8 0AT, UK and at your own cost and risk.

Once you have notified Belle Media that you are withdrawing your order, any sum debited to Belle Media from your credit card, or any cheque payment received by Belle Media, will be re-credited to your account, or otherwise refunded, as soon as possible and in any event within 30 days of your cancellation, but always providing Belle Media have received back any goods dispatched to you and providing that they are returned in perfect condition.

Availability of goods you order

If Belle Media has insufficient stock to deliver the goods ordered, we will notify you as soon as possible of our consequent inability to fulfill your order. Notification will be by email to the address given by you in your order form, or failing such information being available, otherwise in writing to the address supplied with the downloadable order form. Any sum debited by us from your credit card, or any cheque payment received for a book purchase will be re-credited to your account. The refund will be made as soon as possible and in any event within 30 days of your order. In such circumstances Belle Media will not be obliged to offer any additional compensation for disappointment suffered.

Delivery of goods to you

Belle Media will post, or arrange a courier on your behalf, for the goods ordered by you to the person and address you give Belle Media at the time you make your order. Please note – For goods delivered outside of the EU, the person to whom the consignment is sent will be responsible for both customs clearance and any payment of customs duties and/or local taxes where required.

Delivery will be made as soon as possible after your order is accepted and in any event within 60 days of dispatch of the order – estimated delivery times outside the UK are available on request. All delivery times quoted on the website are estimates only, and based on availability, normal processing and the performance of third party delivery companies.

Data

In ordering from this site you consent to Belle Media retaining your email details and purchase history and you agree that Belle Media may email you from time to time in regards to other products and services it provides that it believes may be of interest. Should you wish to remove yourself from our email database you can do so by notifying us of your request at enquiries@bellemedia.co.uk. Belle Media will not pass on your details to third parties unless necessary to do so in fulfillment of the contract.

Liability

If the goods are not what you ordered or are damaged or defective Belle Media shall have no liability to you unless you notify Belle Media of the problem, in writing to enquiries@bellemedia.co.uk within 10 working days of delivery.

If you do not receive goods ordered by you within 30 days of the date on which they were dispatched to you, Belle Media shall have no liability to you unless you notify Belle Media of the problem in writing at enquiries@bellemedia.co.uk within 40 days of the date on which the goods were dispatched to you.

Belle Media’s only obligation will be to make good any shortage or non-delivery; to replace or repair any goods that are damaged or defective; or to refund to you the amount paid by you for the goods. Belle Media will decide at its option which of the remedies is required.

Belle Media will not be liable to you for any indirect or consequential loss or damage arising out of any problem under this condition and Belle Media shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question.

Nothing in this condition is intended to limit any rights you might have as a consumer under applicable local laws nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

Nothing in this contract creates any right which is enforceable by any person who is not a party to the contract.

Force Majeure

Belle Media shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

Invalidity

If any part of these conditions is unenforceable (including any provision in which Belle Media excludes its liability to you) the enforceability of any other part of these conditions will not be affected.

Governing Law

The contract between us shall be governed by and interpreted in accordance with English law, and the English courts shall have jurisdiction to resolve any disputes between us.

Entire Agreement

These terms and conditions, together with the current Belle Media website prices, delivery details and Belle Media contact details, set out the whole of our agreement relating to the supply of the goods to you by Belle Media.

Disclaimer

The information contained in this site may contain technical inaccuracies or typographical errors. All liability of Belle Media howsoever arising from any such inaccuracies or errors is expressly excluded to the fullest extent permitted by applicable law.

Neither Belle Media nor any of its Directors, employees or other representatives will be liable for damages arising out of or in connection with the use of this site in any way.
